All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Rémi Bergougnoux or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of Rémi Bergougnoux, with copyright authorship for this collection by Rémi Bergougnoux, and protected by international copyright laws.

 

1. Orders

1.1. All orders placed by you through this Site will be subject to these terms and conditions.

1.2. All orders shall be deemed to be an offer by you to purchase the Products. We are under no obligation to accept your order (whether or not the order has been acknowledged).

1.3. We will send you an email to acknowledge receipt of your order; this does not constitute our acceptance of your order. Once payment for the Products has been received, we will confirm that your order has been accepted.

1.4. If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available or because of an error in the price on our site, we will inform you as soon as we are aware of it. If you have already paid for the Products, we will refund you the full amount as soon as possible.

1.5. Our acceptance of your order brings into existence a legally binding contract between us with respect to such order.

1.6. If there are any problems with your order, you will be contacted by the owner of this site.

 

2. Payment policy

2.1. The price for the Products that you order will be the price quoted on the Site at the date the order is received.

2.2. Prices include delivery, unless otherwise stated on the Site.

2.3. Payments are made through several method including but not limited to PayPal and credit card.

 

3. Shipping/delivery

3.1. We may use third party service providers to produce our prints therefore the delivery may be dependent on these third parties 

3.2. The Company aims to deliver your Products as soon as possible after placing your order. If we cannot deliver the Products within 30 days of your order, we will notify you and you will be entitled to cancel your order and a refund will be made to you. In no event shall we be liable to pay for any damages or penalty for any delay in delivery of the Products however caused.

3.3. You are required to notify customer services at visual.escape.photography@gmail.com within 14 days if any Products are missing or damaged on delivery. Please refer to paragraph 9.2 below.

3.4. Risk in the Products shall pass to you once they have been delivered to the delivery address stipulated in your order and we will not be liable for their loss, damage or destruction after delivery has taken place.

3.5. It is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) in regard to the possession, use and sale of any Products purchased from this Site. By placing an order, you represent that the Products ordered will be used only in a lawful manner.

 

4. Cancellation

4.1. For Bespoke Orders, You may cancel your order at any stage before, and up to seven (7) days after you have placed your order with us, provided we have not dispatched the relevant Products to you. To do this you must notify us in writing at the address above or by sending an email to visual.escape.photography@gmail.com.

4.2. For all orders which are not Bespoke Orders, you may cancel your order before and up to seven (7) working days after the Products are delivered to you provided:

  • 4.2.1. you notify us in writing by sending an email to  visual.escape.photography@gmail.com before the seven (7) days period ends that you wish to cancel the order; and

  • 4.2.2. if the Product(s) have been delivered to you, you will return them to us (at your own cost) in an 'as new' condition as they were on delivery.

4.3. Where you cancel an order in accordance with the procedures at paragraphs 4.2 or 4.3, we will (at your request) either exchange the Products or refund the amount you have paid. Refunds will be credited to the payment method used to make the original purchase.

4.4. We reserve the right to cancel any order (or any part of the order) if for any reason:

  • 4.5.1. the Products ordered by you are no longer available;

  • 4.5.2. the Products cannot be supplied to you in the country where you reside; in which event we will notify you by email and refund any payments you have made for that order or that part of the order.

4.5. We will not be obliged to offer any additional compensation for disappointment suffered if your order is cancelled for any reason.

 

5. Warranty for defective products

5.1. If the Products are materially defective or incorrect on delivery, we shall have no liability to you unless you notify us of the problem within 14 days from the date of delivery by email at  visual.escape.photography@gmail.com.

5.2. If you notify a problem to us we will:

  • 5.2.1. make good any shortage or non-delivery; or

  • 5.2.2. replace any Products that are materially defective or damaged; or

  • 5.2.3. where Products cannot be made good or replaced, refund you the amount paid by you for the Products in question. Refunds will be credited to the payment method used to make the original purchase.

5.3. We ask that you return the damaged or faulty Products to us and we will reimburse your postage costs provided you send to us your supporting receipts.

5.4. The Company shall be under no liability in respect of any defect in the Products arising from your failure to follow instructions when ordering of the Products via the Site, your use of the Products or your misuse or alteration of the Products.

 

6. Return Policy

If the Products are materially defective or incorrect on delivery, we shall have no liability to you unless you notify us of the problem within 7 days from the date of delivery by email at visual.escape.photography@gmail.com.

We ask that you return the damaged or faulty Products to us and we will reimburse your postage costs provided you send to us your supporting receipts.

 

7. Changes o terms and conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 (change this) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
